This legal analysis focuses on the adequacy of Portuguese criminal law to the Directive 2008/99/EC of the European Parliament and of the Council of November 19th, 2008, on the crime of damage against nature. This legal type of crime was consecrated in our country through Decree-Law nº 48/95, of March 15th and inserted in the Penal Code as article 278.º.
